General Conditions of Sale

  1. PURPOSE

1.1. These general terms and conditions (hereafter “GT&Cs”), govern the purchase or sale agreements for all products offered on the website www.superboutique.it, and more specifically, between SUPER s.r.l. (hereafter “SUPER”), with registered office at Piazza San Marco 1, 20121 Milan, Italy, Milan Chamber of Commerce Economic and Administrative Roster No. 1926439, VAT. No. and Tax Code 06968610961, and the Customer, executed via the on-line procedure.

1.2. These GT&Cs are provided to the Customer for reproduction and preservation purposes as prescribed by law and by art. 12 of Italian Legislative Decree no. 70 of 9 April 2003, and are applied by SUPER for the purchase of its products by the Customers and are considered part and parcel of the order confirmation SUPER prepares, having the same contractual content and value between the parties.

1.3. These GT&Cs are considered to be in force at the time of their publication on the internet website www.superboutique.it and hold for all purchase or sale agreements concluded subsequent to said publication.

SUPER reserves the right to amend these GT&Cs, replacing any prior version, starting on the date of their publication on the internet website www.superboutique.it.

1.4. The Customer is deemed to have read, accepted, approved and understood these GT&Cs with the transmission of the purchase order entered on the internet website www.superboutique.it. Therefore the purchase order may not be forwarded unless the Customer has full knowledge of these GT&Cs, by reading and approving them, as also indicated in paragraph 5.1. further on, and, therefore, the order shall be contingent upon the full acceptance of these GT&Cs with specific approval of the clauses indicated pursuant to articles 1341 and 1342 of the Italian Civil Code and Italian Legislative Decree 206/2005 pursuant to the paragraph 5.2 further on as a conditions precedent.

1.5. The Customer shall print, save and/or preserve a copy of these general terms and conditions, in compliance with articles 50 et seq. of Italian Legislative Decree 206/2005.

1.6. SUPER likewise reserves the right to disable its website under its own unquestionable judgment, to perform maintenance work thereon, as well as in the event of market illiquidity.

  1. FINALIZATION OF THE AGREEMENT.

2.1. The agreement is finalized with receipt of SUPER’s written confirmation via email by the Customer.

2.2. The Agreement shall be deemed concluded when SUPER forwards the Customer, at the email address indicated in the purchase order, an email, specifying acceptance of the order containing the price of the product or products, the total shipping expenses and the conditions under which said prices will be collected.

SUPER is free to reject purchase orders if the order was not received in compliance with the on-line purchase procedure, also as regards the data entered by the Customer or for other circumstances SUPER deems unsuitable to allow the conclusion of the agreement; in this case SUPER shall promptly notify the Customer thereof and in any case within fifteen (15) days starting on the day after that on which the Customer submitted the order. If the order form has been submitted and the relative product paid for, within the following 8 (eight) business days, SUPER shall arrange to return the Customer the full consideration or any price already collected, without recognizing interest and/or expenses or charges, the agreement between the parties understood to be canceled.

2.3. The Customer hereby declares he or she is of age and has the legal capacity to proceed with the purchase as provided for by these GT&Cs.

2.4. The Customer may only purchase the product in the sizes, colors and models indicated in the site www.superboutique.it. The items sold on www.superboutique.it are exclusively new and authentic products. SUPER does not sell used or irregular products or of quality inferior to the corresponding market standards. All images and information contained on the site www.superboutique.it and in the product description sheets are merely descriptive and informational support for sales purposes, therefore, without prejudice to the essential features of the products themselves, they might not correspond therewith and must be deemed as merely informational material not necessarily referring to precise product characteristics.

2.5.1. Right to withdrawal. The Customer has the right to withdraw from the agreement finalized with SUPER without any penalties and without specifying the reason thereof within 14 (fourteen) days, starting from date of receipt of the products purchased on the site www.superboutique.it. To withdraw from the agreement, the Customer must fill out the Returned Goods Form and submit it directly on line from the site www.superboutique.it or send an email to customercare@superboutique.it, which will promptly confirm the receipt thereof. Alternatively, the notification of returned goods, again within the term of 14 (fourteen) days, may be forwarded by registered letter with advice of receipt to the address of SUPER SRL at Piazza San Marco no. 1, 20121 Milano (Italy), the posting date stamped on the registered letter shall be considered to be the date of dispatch. SUPER shall forward confirmation of the receipt of the request to withdrawal via email.

After having forwarded the request to return goods to SUPER via the special form, the customer must deliver the product in question to the courier indicated by SUPER or selected in advance by the Customer in case of extra EU shipping, within 8 (eight) days after the formal communication of the restitution of the goods (for example, the Customer sends the notice of restitution on 12.12.2016, he must deliver the product to the courier within and no later than 20.12.2016), entering the returned-goods number on the waybill, as indicated in the instructions provided by SUPER. For items returned via courier indicated by SUPER, the return shipment is free of charge. Any import duty for shipments originating from extra EU countries are deemed to be at the Customer's expense. SUPER reserves the right to refuse unauthorized returns or returns shipped with any carriers other than those indicated in the email with the instructions on how to return goods.

2.5.2. Conditions for exercising the right to withdraw. The right to withdrawal is deemed to be properly exercised where the following conditions are fully met:

  1. With the complete compilation of the Returned Goods Form directly on line via the site www.superboutique.it or the forwarding of email to customercare@superboutique.it, which will be promptly followed by the notification of receipt, within 14 (fourteen) days after the receipt of the product. Alternatively, the notification of restitution may be forwarded by registered letter with advice of receipt to the address of SUPER SRL at Piazza San Marco no. 1, 20121 Milano (Italy), in any case within 14 (fourteen) days after the receipt of the product.
  2. The product must not have been used, worn, washed, or damaged in any way and must not display any alteration or sign of use.
  3. The product must be furnished with an intact, attached tag, with any original packaging and accessories just as it was received.
  4. The product must be returned in its original package, which is considered to all intents and purposes part and parcel of the product itself and may neither be damaged, altered, nor used as the sole external package.
  5. The returned product must be delivered to the courier within 8 (eight) days starting from the date of formal notice of restitution to SUPER.

SUPER reserves the right to request photographic proof before authorizing returns for defective products and to incur the shipment expenses for the returning product.

If all the required conditions have been fully met, SUPER shall reimburse in full the price of the purchased product to the Customer.

SUPER shall not accept the returned product if the returned good fails to comply with all the foregoing terms and conditions. In this case, SUPER shall return the product to the sender at the original shipping address.

2.5.3 Reimbursement times and methods.Upon receiving the returned goods and having checked that all the requirements have been fulfilled, SUPER shall forward the Customer an email specifying acceptance of the returned goods, or if deviations have been observed, an email indicating non-acceptance of the returned goods.

SUPER proposes three different types of compensation to the Customer.

  1. Substitution of size or item. The Customer may exchange the item for a different size or different color, if available. The Customer may likewise exchange it with a different product, paying any differences in price or, in case of replacement with lower-priced items, receiving a voucher for future purchases equivalent to the difference.
  2. Credit for future purchases. As soon as the returned good is received and accepted as compliant, a discount code having the value of the returned item, to be used for later purchases, shall be sent to the Customer. The discount code may be used within 8 (eight) months after the return, for purchases having equal or greater value; for purchases of lesser value, in order to again receive the difference as credit for future purchases, contact SUPER at the email address customercare@superboutique.it to request the replacement of the code.
  3. Reimbursement. Regardless of the payment method used by the Customer, SUPER shall arrange to effect reimbursement as quickly as possible and in any case within 15 (fifteen) days after the date on which it became aware of the exercising of the right of withdrawal, or when the withdrawal complies with all the foregoing conditions and the integrity of the returned product has been verified.

The actual charge-back or refund time of the sums paid for the purchase of the product depends on the payment method used.

For purchases made with credit/debit cards, the time necessary to view the reimbursement depends on the institute that issued the card. The value date of the chargeback shall be identical to that of the charge, so no loss shall occur in terms of banking interest.


For purchases made via PayPal, the refund shall be effected on the Customer's PayPal account and will be visible immediately. The actual reimbursement from the PayPal account to the credit card depends on the institution that issued the card.


For purchases made via cash on delivery, reimbursement shall be made to the current account indicated by the Customer, normally within 7 (seven) business days. Please communicate information to SUPER carefully and correctly so as to avoid delays in chargebacks.

In the case of gifts, reimbursement shall be made to the customer who made the payment.

  1. CONSIDERATION/PRICE. DELIVERY.

3.1. The Customer is obliged to make full payment of the amount indicated in the order confirmation received via email and with the methods indicated therein.

The prices published on the website, the payments and invoices of the orders are in euro.

SUPER, having received the payment, shall dispatch the order within the estimated and non-binding term of 15 (fifteen) business days.

In no case and for no reason shall SUPER be obliged to pay any type of indemnification for any direct and indirect damages due to delivery delays and that is because the terms indicated and accepted are, as was stated, merely estimates and not binding. The Customer is nevertheless obliged to accept delivery of the purchased items.

3.2. The product or products, with the relative fiscal documentation, shall be shipped exclusively to the address indicated by the Customer in the order form. The product or products shall be delivered to the Customer only or to a person indicated as the person authorized to accept delivery, and that exclusively by filling out the special delegation form to be forwarded to SUPER by email customercare@superboutique.it.

3.3. The product or products are delivered in a closed and sealed envelope and therefore, upon delivery by the assigned courier, the Customer must check that the package is intact, undamaged or in any case not altered or abraded, including at the closure. Any problems should be immediately reported to the courier and concomitantly to SUPER (by email to customercare@superboutique.it) and the same holds for the correspondence or completeness of anything received, for the attached fiscal documentation and for the purchase order, all of which must be obligatorily reported in writing within and no later than 24 (twenty-four) hours after delivery.

3.4. The Customer acknowledges that in the event of his or her failure to accept delivery of the purchased product or products, it or they shall be deposited c/o the courier’s branch office. In this case, within 15 (fifteen) business days after communication of the deposit by the courier, SUPER shall notify the Customer via email so the Customer can arrange for the pickup or re-delivery. The date of acceptance/execution of these general terms and conditions, paragraph 5.1. and that of specific acceptance of paragraph 5.2., shall be that resulting from SUPER’s IT systems and from the providers thereof.

  1. DISCLOSURE PURSUANT TO ART. 13 OF ITALIAN LEGISLATIVE DECREE 196/03 REGARDING THE PROTECTION OF PERSONAL DATA.

To the intents and purposes of the Italian Privacy Code, the Customer hereby states it has received and carefully reviewed the respective information regarding privacy, (also published on SUPER’s internet website www.superboutique.it) and provided for by art. 13, as well as the due rights pursuant to art. 7; as a result thereof, the Customer grants consent to the processing and communication of his or her personal data. The Customer’s data shall be processed c/o the data controller of SUPER srl Piazza San Marco 1, 20121 Milan, Italy tel. +39 02 65560774, email customercare@superboutique.it.

  1. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS AND RELEVANT SPECIFIC APPROVAL OF SOME OF THEM.

5.1. SUPER shall not dispatch any order received if the Customer has not first expressed his or her full acceptance of these GT&Cs signing the relative consent.

5.2. Pursuant to articles 1341 and 1342 of the Italian Civil Code and of the provisions of the Consumer Code, the Customer hereby states he or she specifically accepts the following clauses, affixing his or her signature in consent:

2.4. The Customer may only purchase the product in the sizes, colors and models indicated signing his or her relative consent on the site www.superboutique.it. The items sold on www.superboutique.it are exclusively new and authentic products. SUPER does not sell used or irregular products or of quality inferior to the corresponding market standards. All images and information contained on the site www.superboutique.it and in the product description sheets are merely descriptive and informational support for sales purposes, therefore, without prejudice to the essential features of the products themselves, they might not correspond therewith and must be deemed to be mere informational material and not necessarily referring to precise product characteristics.

The date of acceptance/execution of these general terms and conditions, paragraph 5.1. and that of specific acceptance of paragraph 5.2., shall be that resulting from SUPER’s IT systems and from the providers thereof.

  1. FINAL PROVISIONS.

6.1. The Customer hereby declares it accepts that all matters relative to the use of the site www.superboutique.it, none excluded, shall be subject to Italian law and therefore Italian law alone applies hereto, with the exclusion of every other law, including the legislation of the United Nations relative to the sale of goods. SUPER in no way warranties that the website content complies with regulatory requirements in force in other countries. Access to the site from places where the respective content is considered illegal is expressly prohibited. Any Customers who decide to access the site www.superboutique.it from said countries are fully aware of the legal consequences and of the sanctions they may incur and shall be solely responsible for complying with the local laws.

6.2. Should one or more of these provisions be found ineffective, this shall not prejudice the effectiveness of the other provisions.
